One-year custody not a condition for bail under PMLA, says Supreme Court to ED
The Supreme Court on Monday clarified that there is no "rule" requiring an accused in a money laundering case to spend at least a year in jail before being granted bail. The observation came while hearing a plea in the Chhattisgarh liquor scam case, where one of the accused spent over nine months in custody. When the enforcement directorate's counsel argued that bail should not be granted as the accused had not completed a year in jail since his arrest in August last year, a bench comprising Justices Abhay S Oka and Ujjal Bhuyan stated that such a time-based condition for bail does not exist.
